Otis K. Lee, together with others, was charged with abortion in violation of Code § 26-1102. The defendant was tried separately in the Criminal Court of Fulton County, and was convicted. He petitioned the superior court for a writ of certiorari. The petition was sanctioned, but upon hearing was denied and the exception here is to that judgment. 1. One of the two grounds of certiorari insisted upon by the defendant is that the written statement of the defendant which was introduced in evidence, being only an incriminatory admission, does not amount to a confession, and that it was error for the trial court to give in charge the law as it relates to confessions of guilt.
